Task Completion

At Hive of Creatives, we are committed to providing focused, high-quality service for each task we undertake. To ensure this, we operate on a one-task-at-a-time basis. This means that we will fully complete and seek your sign-off on the current task before proceeding to the next one. This approach allows us to dedicate our full attention and resources to each individual task, ensuring the highest quality of work. Please note that there is no overlapping of tasks; each task is handled separately and sequentially. We appreciate your understanding and cooperation in this process, which we believe serves to enhance the quality and efficiency of our work.

Customer Portal and Ticketing System

At Hive of Creatives, we provide each of our clients with a private customer portal. This portal is exclusive to your company and is designed to facilitate efficient communication and task management. All tasks should be submitted through our ticketing system available in the customer portal.

The ticketing system allows you to create a new ticket for each task, providing a clear and organised way to track and manage your requests. Each ticket is handled individually, ensuring that every task receives our full attention. We kindly ask that all communication and requests related to a task be made through the corresponding ticket. This helps us maintain a comprehensive record and understanding of each task, ultimately enabling us to serve you better.

Communication and Scheduling

At Hive of Creatives, we value effective and efficient communication. To ensure we can provide focused attention to each client, we have designated a daily call window from 12 PM to 1 PM for phone and video calls. Each call is limited to 15 minutes and must be scheduled online in advance. If a longer call is required, this can be arranged separately to ensure we can dedicate the appropriate time and resources to address your needs.

Most of our communication is conducted through the task-specific threads in the client portal, which allows for clear, organised, and trackable correspondence. For quick questions or urgent matters, we also offer a live chat feature. We encourage you to utilise these communication channels to ensure efficient and effective service.

Ownership, Trademarks & Provided Assets

You own all graphics and files we create during any month paid in full. You will provide all content/copy to be used in our designs. You agree that any materials provided are proofed and approved to be used in your designs and are not owned or trademarked by a different entity.

Intellectual Property Rights

All intellectual property rights in the work created by Hive of Creatives, including but not limited to designs, text, graphics, images, and software, are and will remain the exclusive property of Hive of Creatives, unless otherwise agreed in writing. The work is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Any use of the work, other than as expressly permitted herein, is prohibited without the prior written consent of Hive of Creatives.

Confidentiality

At Hive of Creatives, we respect the privacy of our clients and are committed to maintaining the confidentiality and security of your personal information. All personal information that we collect from you will be processed in accordance with our Privacy Policy. As part of our commitment, we may require you to provide certain information by which you can be identified when using our services. You can be assured that this information will only be used in accordance with this confidentiality statement.

We will not sell, distribute, or lease your personal information to third parties unless we have your explicit permission or are required by law to do so. We may use your personal information to send you promotional information about third parties that we think you may find interesting, but only if you tell us that you wish this to happen.

Any information you provide to us, or that we collect through your use of our services and that can be used to identify you, is stored securely and confidentially and is processed fairly and lawfully in accordance with this privacy policy.

Output and Delivery

At Hive of Creatives, we strive for perfection in our work. However, due to the inherent complexities of creative design, we cannot guarantee that all files delivered will be 100% error-free. Upon delivery of files, you agree to review and proof all files for any errors or omissions. Should you find any discrepancies, please notify our team immediately so we can make the necessary corrections. While we will make every effort to expedite any edits, Hive of Creatives cannot be held responsible or liable for any losses or expenses incurred as a result of errors or omissions in the delivered files.

Our team is capable of handling daily requests and revisions, but please note that our output volume is dependent on a variety of factors, including the total volume and complexity of requests. While we will do our utmost to accommodate any priority items and your timelines, we advise against using our service for time-sensitive requests. As long as you have a design request in your queue, our designers will work on it every business day and provide you with daily updates.

Subscriptions

When you subscribe to Hive of Creatives, you agree to a monthly subscription plan. This subscription will automatically renew at the end of each billing cycle, and you will be automatically billed the applicable subscription fees plus any applicable taxes via your chosen payment method. If you wish to change your subscription plan or payment method, you can do so at any time by contacting our customer service.

Please note that changes to your subscription will not take effect until the start of your next billing cycle.

Payment through Stripe

All payments for Hive of Creatives services are processed securely through Stripe, a leading online payment processing platform. By choosing to use our services, you agree to abide by all terms and conditions set forth by Stripe in addition to our own terms and conditions. When you provide your payment information, it is directly sent to and stored on Stripe’s secure servers. Hive of Creatives does not store your payment information on our servers and has no direct control over its handling. By agreeing to our terms and conditions, you also agree to be bound by Stripe’s terms and conditions. If you have any questions or concerns about your payment, please contact us.

Money Back Guarantee

Clients may request a refund within the first 14 days of purchasing a new subscription plan. After this 14-day window, no refunds will be issued for partial subscription plans under any circumstances, including unused time on a plan. We reserve the right to refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behaviour, as determined at our sole discretion. Any promotions, upgrades, or adjustments to existing plans are non-refundable. As the client, it is your responsibility to utilise the services of Hive of Creatives after payment.

To qualify for a refund, you must meet the following criteria:

  • You must have submitted at least two requests with clear directions.
  • You must have provided actionable feedback or revisions during the design process for the requests you sent in.

Without meeting these two requirements, we will not issue any refunds as this will be classified as an abuse of the service. If you signed up by mistake, you can request a refund within 24 hours of signing up. In this case, or if you haven’t met the two requirements above or if you cancel before 7 days of signing up, we will issue a refund of the amount paid minus the processor’s fee (Stripe).

Refunds

There are no refunds for partial subscription plans under any circumstance, including unused time on a plan.

You may cancel your subscription with Hive of Creatives at any time. When you cancel, your account will be active through the end of your paid billing term. Alternatively, if you wish to pause your subscription, you may do so through your portal. While your subscription is paused, you will not be billed, and no services will be provided. You can reactivate your subscription at any time to resume receiving services.

User Conduct

You agree to use our services in a manner that is lawful, relevant, and proper to the applicable forum. Any use of our services that Hive of Creatives, in its sole discretion, finds inappropriate and/or offensive may result in suspension and/or termination of a user with or without notice.

Termination

Either party may terminate this agreement at any time by providing written notice to the other party. Upon termination, all rights and obligations under these terms and conditions, including all licences granted hereunder, shall immediately cease, except that any terms or conditions that by their nature should survive termination shall survive termination.

Third-Party Links or Services

Our services may include links to third-party websites or services that are not owned or controlled by Hive of Creatives. Hive of Creatives has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Hive of Creatives shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

System Abuse and Rights Reserved

At Hive of Creatives, we provide our services with the expectation of fair and respectful use by our clients. Any attempt to manipulate, abuse, or exploit our system, services, or terms and conditions is strictly prohibited and may result in the immediate termination of your subscription. This includes, but is not limited to, excessive submission of tasks, unreasonable demands beyond the scope of our services, or any form of harassment towards our staff.

We reserve the right to determine, at our sole discretion, what constitutes system abuse and to take appropriate action, including termination of your subscription without prior notice. We also reserve the right to make changes to our terms and conditions, services, and pricing at any time, for any reason, and without prior notice.

Public Liability

Hive of Creatives carries public liability insurance coverage for its services. However, Hive of Creatives is not responsible for any damages, injuries, or losses incurred as a result of the use or misuse of the work we provide. The client assumes all responsibility for the use of any materials, products, or services provided by Hive of Creatives. It is the client’s responsibility to ensure that the products and services they receive do not infringe on any patents, copyrights, or other legal rights. Any claim related to the materials, products, or services provided by Hive of Creatives should be directed to the client’s own insurance carrier.

Force Majeure

Hive of Creatives shall not be considered in breach of or default under these Terms and Conditions or any contract with the customer, and shall not be liable to the customer for any cessation, interruption, or delay in the performance of its obligations hereunder by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labour strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “”Force Majeure Event”).

Examples of our work

By engaging with our services, you grant Hive of Creatives a non-exclusive right and licence to use and display the work we create for you as part of our portfolio, on social media, and in other marketing and communication materials. This is to showcase our skills and the variety of projects we have undertaken. If you would prefer for your work not to be used in this way, please let us know. You can revoke this right at any time by sending a written notification to our team at support@hiveofcreatives.co.uk. Upon receipt of your written request, we will cease to use your work in our promotional activities.

Limitations of Liability and Indemnification

Hive of Creatives, including its directors, employees, members, independent contractors, or agents, shall not be liable to the Client or any third party for any direct, indirect, consequential, incidental, special, or punitive damages. This includes, but is not limited to, lost profits, lost revenue, lost data, attorneys’ fees, court costs, fines, forfeitures, or other damages or losses resulting from the Client’s use of the Website.

The Client agrees to defend, indemnify, and hold harmless Hive of Creatives, its subsidiaries, affiliates, officers, members, agents, partners, employees, and independent contractors against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses. This indemnification applies to claims made by any third party due to or arising out of: (1) the Client’s use of the Website; (2) any breach of these Terms of Use by the Client; (3) any breach of the Client’s representations and warranties set forth herein; (4) the Client’s violation of the rights of any third party, including but not limited to intellectual property rights.

Notwithstanding the foregoing, Hive of Creatives reserves the right, at the Client’s expense, to assume the exclusive defence and control of any matter for which the Client is required to indemnify Hive of Creatives. The Client agrees to cooperate with Hive of Creatives in defending such claims.

Dispute Resolution

In the event of a dispute arising out of or relating to these terms and conditions, including any question regarding its existence, validity, or termination, the parties shall first seek settlement of that dispute by negotiation. If the dispute cannot be settled by negotiation, the parties agree to submit to the exclusive jurisdiction of the courts of the United Kingdom.

Disclaimer

The information provided on the Hive of Creatives website is for general informational purposes only. All information on the site is provided in good faith, however, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the site.
